Terms and Conditions of Sale
1. Definition and object of the contract
1.1 This contract (hereinafter, "Contract") is governed in accordance with Article 50 of Legislative Decree no. 206 of 6 September 2005 ("Consumer Code"). The object of this agreement is the sale of movable goods between Queen Moda Snc, Via Durece 86, 84017 Positano (SA), P.IVA IT02413880655 ("Queen Moda") and the consumer (the "Client"). The Contract is concluded with the acceptance by Queen Moda Snc. of the purchase order issued by the Customer from the internet page www.queenmodapositano.com ("Site"), on the basis of the modalities described in art. 3 below.
1.2 These general conditions of sale ("General Conditions") and, in particular, the information referred to in Article 59 of the Consumer Code, as provided by Queen Moda during the sale and reported on the Site, will remain in force until they are amended and/or supplemented by Queen Moda. Any changes and/or additions to the General Conditions will be effective from the date on which they are communicated to the public and will apply to sales made from that date. The latest updated version of these General Conditions is the one available on the Website.
2. Prices
2.1 The sale prices of the products sold on the Site are inclusive of VAT and/or any other tax. Delivery costs will be calculated during the sale.
2.2 The prices of all products are inclusive of VAT and/or any other tax. In addition to the price of the product at the end of the purchase process, it must be considered the possible cost of shipping based on the customer's address.
3. Purchasing and payment methods
3.1 The Contract is concluded at the time of payment, by sending the order confirmation to the Customer.
3.2 The Customer has 24 hours to withdraw from the contract obtaining a full refund, without any penalty and without specifying the reason.
3.3 The customer can choose one of the following payment methods: credit card, prepaid, PayPal, bank transfer or cash on delivery. No commission will be applied to the Customer for the chosen means of payment.
4. Products delivery - complaints
4.1 Queen Moda delivers the products to the address indicated by the Customer within 7-10 days from the conclusion of the Contract*. During the realization of the garment the Customer can be constantly informed about the status of the order by accessing the personal page on the Site (Account - Orders).
* The expected shipping date varies depending on the payment method and shipping address. Any change in delivery time will be communicated to the Customer by e-mail
4.2 When the goods are shipped, the Customer will receive an e-mail at the address indicated at the time of order containing the tracking number with which to monitor the progress of delivery.
4.3 Should the Customer not receive the item(s) purchased or should the shipment be subject to unforeseen and undisclosed delays, please contact us at info@queenmodapositano.com.
4.4 Queen Moda garments are handcrafted. Therefore, a tolerance of variation of 2 cm of the measurements is provided and allowed.
4.5 Queen Moda constantly invests to offer a photographic representation of its products as realistic as possible. However, due to the digital rendering of images on the web, the various light settings of the screens or other external conditions, it is still possible that the representation of products online is not completely in line with reality. By proceeding with the purchase, the Customer accepts that there may be minor discrepancies in this regard.

5. Customer Obligations
5.1 The Customer states and warrants: (i) to be a consumer according to the provisions of art. 3 of the Consumer Code; (ii) to be of legal age; (iii) that the data provided by the same for the execution of the Contract are correct and truthful.
6. Withdrawal right
6.1 The Customer has the right to withdraw from the Contract stipulated, without penalty and without the obligation to specify the reason, within 24 hours of receipt of the order confirmation. The Customer may exercise the right of withdrawal from the contract, within the above mentioned period, by telephone or e-mail.
To ensure a high service, Queen Moda Snc. provides for the return of the amount spent after returning the purchased products within 14 days from the shipment of goods, if the packaged garment presents: structural imperfections, problems of fit or impossibility of changes. Conditions and procedures are specified in the Returns and Refunds page.
6.3 Any product sent without following the procedure displayed on the Returns and Refunds page will not be accepted and will be returned to the sender, without issuing any refund.
6.4 The item must be returned intact (unused and in the original packaging) together with the approved Return Form.
6.5 Satisfied the above conditions, the buyer is entitled to a refund of the full amount excluding the shipping costs. Coupons or Discount Coupons used to purchase the item will be replaced with new Coupons or Discount Coupons to be used for other purchases.
7. Jurisdiction
7.1 This Contract is governed by the Italian law.
7.2 Any dispute relating to the application, execution, interpretation and violation of the Contract will be the competence of the Court of Salerno.
